এই সময় ডিজিটাল ডেস্ক - পশুখাদ্য কেলেঙ্কারি মামলায় দোষী সাব্যস্ত হলেন প্রাক্তন কেন্দ্রীয় রেলমন্ত্রী লালুপ্রসাদ যাদব। পশুখাদ্য কেলেঙ্কারিতে আরও ৪৫ জনকেও দোষী সাব্যস্ত করেছে রাঁচির বিশেষ সিবিআই আদালত। ৩ অক্টোবর লালুপ্রসাদের সাজা ঘোষণা হবে।


আইনজীবীর বক্তব্য অনুযায়ী, ৩ থেকে ৭ বছরের কারাদণ্ডে দণ্ডিত হওয়ার সম্ভাবনা লালুপ্রাসদের। এদিন আদালত চত্বরে বিশেষ নিরাপত্তার ব্যবস্থা করা হয়েছিল। ৯৫০ কোটি টাকার এই পশুখাদ্য কেলেঙ্কারি মামলা চলছে দীর্ঘদিন ধরে। ১৯৯৬ সালে চাইবাসা ট্রেজারি থেকে গবাদি পশুর খাবার কেনার নামে তুলে নেওয়া হয় ৩৭ কোটি সত্তর লক্ষ টাকা। বিহারের প্রাক্তন মুখ্যমন্ত্রী লালুপ্রসাদ যাদব ও আরও এক প্রাক্তন মুখ্যমন্ত্রী জগন্নাথ মিশ্র সহ একাধিক ব্যক্তির বিরুদ্ধে এফআইআর দায়ের হয়। পাটনা হাইকোর্ট এই ঘটনার সিবিআই তদন্তের নির্দেশ দেয়। ২০০১ সালে রাঁচির সিবিআই আদালতে মামলা স্থানান্তরিত হওয়ার পর আদালতে আত্মসমর্পণ করেন লালুপ্রসাদ যাদব।


কিছুদিন আগেই দাগী সাংসদদের ভোটে দাঁড়ানো ও সাংসদ পদ বাতিল করার নির্দেশ দিয়েছে সুপ্রিম কোর্ট। দাগী সাংসদদের বাঁচাতে কেন্দ্রের আনা অর্ডিন্যান্সে এখনও সই করেননি রাষ্ট্রপতি প্রণব মুখোপাধ্যায়। অর্ডিন্যান্সের তীব্র বিরেধিতা করেছেন কংগ্রেসের সহ সভাপতি রাহুল গান্ধি। এই অবস্থায় অর্ডিন্যান্স বাতিল হওয়ারই সম্ভাবনা। তাই লালু প্রসাদের তিন থেকে সাত বছর কারাদণ্ড হলে তাঁর সাংসদ পদ খারিজ হতে পারে।

Indian Express reports aptly,in a body blow to RJD before next year's Lok Sabha polls, its President Lalu Prasad was on Monday convicted by a special CBI court here in the fodder scam corruption case that disqualifies him from Parliament and renders him ineligible for contesting elections for at least six years.

The court fixed October three for pronouncement of sentence against Yadav, Mishra and others. The RJD chief was taken to the Birsa Munda Central Jail in Ranchi after being convicted by the court.

The RJD chief faces immediate disqualification as Lok Sabha member under a recent Supreme Court order that an MP or MLA would stand disqualified immediately if convicted by a court for crimes with punishment of two years or more and under some other laws even without jail sentence.

The August judgement of the Supreme Court struck down a provision in the electoral law that provided protection to sitting MPs and MLAs by allowing them to continue in their posts if they appeal against a lower court conviction and secure a stay of the order.

Lalu would have got protection from disqualification if the ordinance promulgated by the Centre was cleared by President Pranab Mukherjee but he is said to have some reservations and raised questions over it.

Government sources on Monday said that a meeting of the Union Cabinet has been convened on October 2 to deliberate on the Ordinance that seeks to protect convicted lawmakers by circumventing a Supreme Court order.

Congress Vice President Rahul Gandhi has forced the Congress to have a relook at the Ordinance after he called it a "complete nonsense" and said that it should be "torn up and thrown away."

The Ordinance is currently before President Pranab Mukherjee who is leaving on a foreign tour on October 2.

The President has already met Home Minister Sushil Kumar Shinde, Parliamentary Affairs Minister Kamal Nath and Law and Justice Minister Kapil Sibal to seek clarifications about the Ordinance.

An indication about the likely fate of the Ordinance was available when Nath said that Gandhi expressed the view of many many people in the party, obviously suggesting that the government should have a "re-look" into it. His deputy in the ministry Rajiv Shukla had also insisted that the party's job is to give direction to the government.

Meanwhile,union minister of state for Railways Adhir Ranjan Chowdhury Sunday accused CM Mamata Banerjee of getting a supplementary chargesheet filed against him in a two year old case so that he was "put behind the bars and the Congress in the state got weakened".

"The CM has become both malicious and vindictive. Malicious, because of my performance in railways and vindictive, because of my politics. In fact, she is trying to misuse the Supreme Court ordinance on banning tainted people's representatives,'' Chaudhury told The Indian Express from Delhi.

Adhir, against whom a non-bailable arrest warrant has been issued for alleged conspiracy in a murder case, was chargesheeted by the police in a Murshidabad court Saturday. The charge sheet alleged that Chowdhury conspired in the murder of Trinamool Congress worker Kamal Sheikh in Golabazar area of the district in 2011. Ten people have been named of which eight have been arrested, while two others, including Adhir, have been been mentioned as 'absconding.'

चारा घोटाले से जुड़े एक मामले में यहां सीबीआई की विशेष अदालत ने आज बिहार के पूर्व मुख्यमंत्री एवं राजद नेता लालू प्रसाद तथा पूर्व मुख्यमंत्री जगन्नाथ मिश्र समेत सभी 45 आरोपियों को दोषी करार दिया। इनमें से सात लोगों को जहां आज ही 3 साल तक की कैद की सजा सुना दी गई वहीं शेष 38 लोगों को वीडियो कांफ्रेंसिंग के जरिए आगामी 3 अक्तूबर को सजा सुनाई जाएगी। जिन सात लोगों को आज सजा सुनाई गई उनमें दो राजनीतिज्ञ ध्रुव भगत और बिहार के पूर्व मंत्री विद्यासागर निषाद तथा एक आईएएस अधिकारी और चार आपूर्तिकर्ता शामिल हैं। अदालत ने यह फैसला 950 करोड़ रुपए के चारा घोटाले से जुड़े चाईबासा कोषागार से फर्जी ढंग से 37.7 करोड़ रुपये निकालने के मामले में सुनाया है।


दोषी ठहराए जाने के बाद अदालत से बाहर आते हुए लालू (65) शांत नजर आ रहे थे। उन्होंने किसी सवाल का जवाब नहीं दिया और अपनी कार से रांची के बाहरी इलाके में तथा राष्ट्रीय खेलगांव के नजदीक स्थित जेल चले गए। इसके पूर्व सफेद एंबेसडर कार से अदालत पहुंचे लालू सहज नजर आए और पार्टी समर्थकों का हाथ हिलाकर अभिवादन किया। जब न्यायाधीश ने उनके खिलाफ फैसला पढ़ना शुरू किया तो लालू अदालत कक्ष में दूसरी पंक्ति में बैठे थे।


बिहार के पूर्व मुख्यमंत्री एवं राजद प्रमुख लालू प्रसाद को दोषी ठहराए जाने के साथ ही उनके सामने सांसद के रूप में अयोग्य होने का खतरा पैदा हो गया है । इसके साथ ही इस बात का भी खतरा पैदा हो गया है कि वह कम से कम छह साल तक चुनाव नहीं लड़ पाएंगे । अदालत द्वारा दोषी ठहराए जाने के बाद लालू प्रसाद को बिरसा मुंडा सेंट्रल जेल ले जाया गया ।


उच्चतम न्यायालय के हाल में आए फैसले के मद्देनजर राजद प्रमुख के सामने लोकसभा सदस्य के रूप में अयोग्य ठहराए जाने का तत्काल खतरा पैदा हो गया है । शीर्ष अदालत ने अपने फैसले में कहा था कि अगर किसी सांसद या विधायक को किसी अदालत द्वारा दो साल या इससे अधिक की सजा वाले किसी अपराध में दोषी ठहराया जाता है तो वह तत्काल अयोग्य माना जाएगा।


सीबीआई के विशेष न्यायाधीश प्रवास कुमार सिंह ने लंबे समय से चल रहे इस मामले में बहस पूरी हो जाने के बाद इस वर्ष 17 सितंबर को अपना फैसला सुरक्षित रख लिया था। लालू प्रसाद आज का फैसला सुनने के लिए अपने लाव लश्कर के साथ कल शाम पटना से विमान के जरिए रांची पहुंचे थे। इस मामले में लालू के वकील सुरेन्द्र सिंह ने नौ सितंबर को अपनी अंतिम बहस शुरू की थी। बहस के अंतिम दिन 17 सितंबर को भी वकील ने दावा किया था कि बिहार के तत्कालीन मुख्यमंत्री के खिलाफ इस मामले में अभियोजन की स्वीकृति राज्यपाल ने असंवैधानिक ढंग से दी थी और इसके लिए उन्होंने बिहार मंत्रिपरिषद् से सलाह नहीं ली थी। उन्होंने दावा किया था कि इस मामले में चूंकि लालू के खिलाफ अभियोजन की स्वीकृति ही गलत ढंग से दी गयी थी, अत: उनके खिलाफ पूरा अभियोजन ही अवैध है।


दूसरी ओर, केन्द्रीय जांच ब्यूरो ने लालू के इस दावे को खारिज करते हुए दलील दी थी कि बिहार के तत्कालीन राज्यपाल ने इस मामले में अभियोजन की जो स्वीकृति दी थी, वह बिल्कुल वैध थी और इसके लिए मंत्रिपरिषद् से सलाह लेना जरूरी नहीं था।


उच्चतम न्यायालय ने इस वर्ष अगस्त में चुनाव कानून के एक प्रावधान को खारिज कर दिया था जिसके तहत निचली अदालत के फैसले के खिलाफ अपील किए जाने या फैसले पर स्थगन हासिल कर लेने के बाद वर्तमान सांसदों और विधायकों को पद पर बने रहने के लिए संरक्षण प्राप्त था। यदि केंद्र सरकार द्वारा इस संबंध में लाए गए अध्यादेश को राष्ट्रपति प्रणब मुखर्जी मंजूर कर लेते तो लालू को अयोग्यता से संरक्षण मिल जाता। समझा जाता है कि राष्ट्रपति ने अध्यादेश पर कुछ आपत्ति तथा सवाल उठाए हैं।


इस बीच, राहुल गांधी ने अध्यादेश वापस लेने की मांग कर इसके भाग्य पर सवालिया निशान लगा दिया है। राजद प्रवक्ता मनोज झा ने कहा कि सजा सुनाए जाने के बाद फैसले को उच्च अदालत में चुनौती दी जाएगी। सत्रह साल पुराने इस मामले में दोषी ठहराने का फैसला सुनाए जाने से पूर्व लालू प्रसाद यहां विशेष सीबीआई अदालत पहुंचे। अदालत ने 17 सितंबर को मामले में फैसला सुनाने के लिए आज की तारीख निर्धारित की थी। दोषी ठहराए गए अन्य लोगों में आईएएस अधिकारी महेश प्रसाद, फूलचंद सिंह, बेक जुलेअस, के. अरूमुगम, आयकर अधिकारी एसी चौधरी, पूर्व एएचडी अधिकारी और चारा आपूर्तिकर्ता शामिल हैं।


उच्चतम न्यायालय ने लालू की उस याचिका को खारिज कर दिया था जिसमें उन्होंने वर्तमान विशेष अदालत से मामला किसी दूसरी अदालत में भेजे जाने का आग्रह किया था। इसके बाद लालू ने 9 सितंबर को बहस शुरू की थी जो 17 सितंबर को पूरी हुई। चारा घोटाले के चलते लालू प्रसाद को बिहार के मुख्यमंत्री पद से इस्तीफा देना पड़ा था।


मुख्यमंत्री के पद पर अपनी पत्नी राबड़ी देवी को बैठाकर लालू ने 31 जुलाई 1997 को पटना की एक अदालत में समर्पण कर दिया था। बाद में वह अदालत के इस आदेश पर रांची पहुंचे थे कि मामला रांची अदालत के अधिकारक्षेत्र में आता है। उनके लिए मेकोन गेस्ट हाउस को कैम्प जेल में तब्दील कर दिया गया था। इसके बाद उन्हें यहां सकरुलर रोड पर स्थित पुरानी बिरसा मुंडा जेल स्थानांतरित कर दिया गया था।


पंद्रह नवंबर 2000 को बिहार से अलग होकर झारखंड के नया राज्य बनने के बाद मामला इस बात के फैसले के लिए उच्चतम न्यायालय पहुंचा कि प्रकरण अविभाजित बिहार का होने के कारण पटना उच्च न्यायालय के अधिकार क्षेत्र में आता है या नहीं । इस तरह मुकदमा काफी समय तक स्थगित रहा।


उच्चतम न्यायालय ने नवंबर 2001 में आदेश दिया कि मुकदमा रांची में विशेष अदालतों में चलेगा। रांची में सात विशेष अदालतों में मार्च 2002 में मुकदमा शुरू हुआ। मामले में 15 मई से बचाव पक्ष की दलीलें शुरू हुईं और लालू के वकील ने उनके पक्ष में 29 गवाहों से जिरह की।


लेकिन जब बचाव पक्ष तारीखों पर लगातार अनुपस्थित होता रहा तो अदालत ने फैसला सुनाने के लिए 15 जुलाई की तारीख निर्धारित की और आरोपियों से 1 जुलाई तक जिरह पूरी करने को कहा। बाद में लालू उच्चतम न्यायालय पहुंचे और राजनीतिक साजिश की आशंका जताते हुए मामला प्रवास कुमार सिंह की अदालत से स्थानांतरित करने का आग्रह किया जिसे शीर्ष अदालत ने नामंजूर कर दिया। इसके साथ ही लालू के खिलाफ पहला फैसला आने का मार्ग प्रशस्त हो गया था।


इस मामले में 56 लोग आरोपी बनाए गए थे। सुनवाई के दौरान सात आरोपियों की मौत हो गई, दो वायदा माफ गवाह बन गए और एक ने आरोप स्वीकार कर लिया और एक को आरोप मुक्त करार दिया गया। इस घोटाले में आरोपी बनने के बाद लालू प्रसाद को 1997 में मुख्यमंत्री पद छोड़ना पड़ा था। यह घोटाला 1996 में सामने आया था। घोटाले से संबंधित 61 में से 54 मामले वर्ष 2000 में पृथक राज्य के रूप में गठित होने के बाद झारखंड स्थानांतरित कर दिए गए थे।

इसे पशुपालन घोटाला ही कहा जाना चाहिए क्योंकि मामला सिर्फ़ चारे का नहीं है. असल में, यह सारा घपला बिहार सरकार के ख़ज़ाने से ग़लत ढंग से पैसे निकालने का है. कई वर्षों में करोड़ों की रक़म पशुपालन विभाग के अधिकारियों और ठेकेदारों ने राजनीतिक मिली-भगत के साथ निकाली है.

घपला रोशनी में धीरे-धीरे आया और जांच के बाद पता चला कि ये सिलसिला वर्षों से चल रहा था. शुरूआत छोटे-मोटे मामलों से हुई लेकिन बात बढ़ते-बढ़ते तत्कालीन मुख्यमंत्री लालू प्रसाद यादव, नीतीश कुमार तक जा पहुंची.

इस घोटाले के आरोपी एसबी सिन्हा के बयान के अनुसार चारा घोटाले का पैसा बिहार के मुख्यमंत्री नीतीश कुमार को भी मिला था। एके झा ने सीबीआइ के विशेष न्यायाधीश आरआर त्रिपाठी की अदालत में बताया कि घोटाले के आरोपी एसबी सिन्हा से बयान लिया गया था। इसी बयान में इसकी पुष्टि हुई है। एसबी सिन्हा ने बताया था कि 1995 के लोकसभा चुनाव में चारा घोटाले के आरोपी विजय कुमार मल्लिक द्वारा एक करोड़ रुपये नीतीश कुमार को भिजवाया गया। यह पैसा उन्हें दिल्ली के एक होटल में दिया गया। नीतीश ने पैसे लेकर धन्यवाद भी कहा। कुछ दिनों बाद फिर घोटाले के आरोपी एसबी सिन्हा ने नौकर महेंद्र प्रसाद के हाथ 10 लाख रुपये पटना में विधायक सुधा श्रीवास्तव के घर पर नीतीश कुमार के लिए भेजे। घोटाले के आरोपी आरके दास ने भी कोर्ट में दिये बयान में बताया था कि उसने पांच लाख रुपये नीतीश कुमार को दिये हैं। नीतीश कुमार 1995 में समता पार्टी के नेता थे। वह एसबी सिन्हा को कहते थे कि पैसा नहीं देने पर मामला उजागर कर दिया जाएगा। तत्कालीन विधायक शिवानंद तिवारी, राधाकांत झा, रामदास एवं गुलशन अजमानी को भी पैसा देने की बात सामने आई है।[1]

मामला एक-दो करोड़ रूपए से शुरू होकर अब 360 करोड़ रूपए तक जा पहुंचा है और कोई पक्के तौर पर नहीं कह सकता कि घपला कितनी रक़म का है क्योंकि यह वर्षों से होता रहा है और बिहार में हिसाब रखने में भी भारी गड़बड़ियां हुई हैं.

मामले के जाल में फंसे लालू यादव को इस सिलसिले में जेल जाना पड़ा, उनके ख़िलाफ़ सीबीआई और आयकर की जांच हुई, छापे पड़े और अब भी वे कई मुक़दमों का सामना कर रहे हैं. आय से अधिक संपत्ति के एक मामले में सीबीआई ने राबड़ी देवी को भी अभियुक्त बनाया है.

घपले की पोल बिहार पुलिस ने 1994 में राज्य के गुमला, रांची, पटना, डोरंडा और लोहरदगा जैसे कई कोषागारों से फर्ज़ी बिलों के ज़रिए करोड़ों रूपए की कथित अवैध निकासी के मामले दर्ज किए.रातो-रात सरकारी कोषागार और पशुपालन विभाग के कई सौ कर्मचारी गिरफ़्तार कर लिए गए, कई ठेकेदारों और सप्लायरों को हिरासत में लिया गया और राज्य भर में दर्जन भर आपराधिक मुक़दमे दर्ज किए गए.

राब़ड़ी देवी भी लपेटे में लेकिन बात यहीं ख़त्म नहीं हुई, राज्य के विपक्षी दलों ने मांग उठाई कि घोटाले के आकार और राजनीतिक मिली-भगत को देखते हुए इसकी जांच सीबीआई से कराई जाए.सीबीआई ने मामले की जांच की कमान संयुक्त निदेशक यू एन विश्वास को सौंपी और यहीं से जांच का रुख़ बदल गया.

शातिर कारगुज़ारी सीबीआई ने अपनी शुरुआती जांच के बाद कहा कि मामला उतना सीधा-सादा नहीं है जितना बिहार सरकार बता रही है.सीबीआई का कहना है कि चारा घोटाले में शामिल सभी बड़े अभियुक्तों के संबंध राष्ट्रीय जनता दल और दूसरी पार्टियों के शीर्ष नेताओं से रहे हैं और उसके पास इस बात के पर्याप्त सबूत हैं कि काली कमाई का हिस्सा नेताओं की झोली में भी गया है. सीबीआई के अनुसार, राज्य के ख़ज़ाने से पैसा कुछ इस तरह निकाला गया- पशुपालन विभाग के अधिकारियों ने चारे, पशुओं की दवा आदि की सप्लाई के मद में करोड़ों रूपए के फ़र्जी बिल कोषागारों से वर्षों तक नियमित रूप से भुनाए.

विपक्ष ने चुनावी मुद्दा बनाया जांच अधिकारियों का कहना है कि बिहार के मुख्य लेखा परीक्षक ने इसकी जानकारी राज्य सरकार को समय-समय पर भेजी थी लेकिन बिहार सरकार ने इसकी ओर कोई ध्यान नहीं दिया.

राज्य सरकार की वित्तीय अनियमितताओं का हाल ये है कि कई-कई वर्षों तक विधानसभा से बजट पारित नहीं हुआ और राज्य का सारा काम लेखा अनुदान के सहारे चलता रहा है.

सीबीआई का कहना है कि उसके पास इस बात के दस्तावेज़ी सबूत हैं कि तत्कालीन मुख्यमंत्री को न सिर्फ़ इस मामले की पूरी जानकारी थी बल्कि उन्होंने कई मौक़ों पर राज्य के वित्त मंत्रालय के प्रभारी के रूप में इन निकासियों की अनुमति दी थी.

जांच के दौरान सीबीआई ने ये दावा भी किया लालू प्रसाद यादव और उनकी पत्नी राबड़ी देवी अपनी घोषित आय से अधिक संपत्ति रखने के दोषी हैं.

व्यापक षड्यंत्र सीबीआई का कहना रहा है कि ये सामान्य आर्थिक भ्रष्टाचार का नहीं बल्कि व्यापक षड्यंत्र का मामला है जिसमें राज्य के कर्मचारी, नेता और व्यापारी वर्ग समान रूप से भागीदार है. मामला सिर्फ़ राष्ट्रीय जनता दल तक सीमित नहीं रहा. इस सिलसिले में बिहार के एक और पूर्व मुख्यमंत्री डॉक्टर जगन्नाथ मिश्र को गिरफ़्तार किया गया. राज्य के कई और मंत्री भी गिरफ़्तार किए गए. सीबीआई के कमान संभालते ही बड़े पैमाने पर गिरफ़्तारियां हुईं और छापे मारे गए. लालू प्रसाद यादव के ख़िलाफ़ सीबीआई ने आरोप पत्र दाख़िल कर दिया जिसके बाद उन्हें अपने पद से इस्तीफ़ा देना पड़ा और बाद में सुप्रीम कोर्ट से ज़मानत मिलने तक वे कई महीनों तक जेल में रहे. मामले के तेज़ी से निबटारे में बहुत सारी बाधाएं आईं. पहले तो इसी पर लंबी क़ानूनी बहस चलती रही कि बिहार से अलग होकर बने झारखंड राज्य के मामलों की सुनवाई पटना हाईकोर्ट में होगी या रांची हाईकोर्ट में.

सीबीआई ने ज़्यादातर मामलों में आरोप पत्र दाख़िल कर दिए हैं और जांच समाप्त हो गई है लेकिन मुक़दमों की सुनवाई शुरू होने में अभी वक्त लगेगा.





चारा घोटाला: लालू यादव दोषी करार, जेल भेजे गए

बिहार के चारा घोटाले से जुड़े एक मामले में सीबीआई अदालत ने पूर्व मुख्यमंत्री और राष्ट्रीय जनता दल के प्रमुख लालू प्रसाद यादव को दोषी ठहराया है.

समाचार एजेंसी पीटीआई के अनुसार अदालत के फैसले के बाद लालू प्रसाद यादव को रांची के बिरसा मुंडा को जेल ले जाया गया.

जनता दल (यूनाइटेड) के नेता साबिर अली ने कहा है कि इस फ़ैसले के बाद लोगों की न्यायपालिका पर आस्था बढ़ेगी, जो ये मानते थे कि नेताओं को कभी सज़ा नहीं मिलती.

रांची की सीबीआई अदालत ने 17 सितंबर को इस मामले में फ़ैसला सुरक्षित रखा था.

इस मामले में जज बदलने की लालू यादव की अर्ज़ी सुप्रीम कोर्ट ने 13 अगस्त को ख़ारिज कर दी थी.

लालू यादव ने अपनी याचिका में ट्रायल कोर्ट के जज पीके सिंह पर भेदभाव बरतने का आरोप लगाया था.

मामला

लालू प्रसाद और 44 अन्य लोगों को चाइबासा कोषागार से 90 के दशक में 37.7 करोड़ रुपए निकालने के मामले में अभियुक्त बनाया गया था.

चाइबासा तब अविभाजित बिहार का हिस्सा था. चारा घोटाले में विशेष अदालतें 53 में से 44 मामलों में पहले ही फ़ैसले सुना चुकी हैं.

बिहार के पूर्व मुख्यमंत्री जगन्नाथ मिश्रा, पूर्व मंत्री विद्या सागर निषाद, आरके राणा और ध्रुव भगत भी इस मामले में दोषी ठहराया गया है.

राणा और भगत को मई में एक केस में पहले ही दोषी करार दिया जा चुका है. चाइबासा कोषागार से कथित फ़र्ज़ी बिल देकर 37.7 करोड़ रुपए निकालने का ये मामला जब सामने आया तो तत्कालीन मुख्यमंत्री लालू प्रसाद यादव ने ध्रुव भगत और जगदीश शर्मा की सदस्यता वाली विधानसभा समिति से इसकी जांच कराने के आदेश दिए थे.

इस मामले में शिवानंद तिवारी, सरयू रॉय, राजीव रंजन सिंह और रविशंकर प्रसाद ने पटना हाईकोर्ट में एक जनहित याचिका दायर की थी. पटना हाईकोर्ट ने 11 मार्च 1996 को 950 करोड़ रुपए के कथित चारा घोटाले के मामलों की जांच सीबीआई को सौंपने का आदेश दिया था.

The Fodder Scam involved hundreds of millions of dollars in alleged fraudulent reimbursements from the treasury of Bihar state for fodder, medicines and husbandry supplies for non-existent livestock.

The Fodder Scam (Devanagari: चारा घोटाला, chārā ghoṭālā) was a corruption scandal that involved the embezzlement of about INR9.5 billion (equivalent to INR20 billion or US$310 million in 2013) from the government treasury of the eastern Indian state ofBihar.[1] Among those implicated in the theft and arrested were then Chief Minister of BiharLaloo Prasad Yadav, as well as former Chief Minister, Jagannath Mishra.[2][3]The scandal led to the end of Laloo's reign as Chief Minister. There is also allegation on Nitish Kumar and Shivanand Tiwari of receiving 1 crore and 60 lakh Rupees respectively from S.N. Sinha.

The theft spanned many years, and allegedly involved numerous Bihar state's administrative and elected officials across multiple administrations of the Indian National Congress and the Janata Dal parties. The corruption scheme involved the fabrication of "vast herds of fictitious livestock" for which fodder, medicines and animal husbandry equipment was supposedly procured.[1][4] Although the scandal broke in 1996, the theft had been in progress, and increased in size, for over two decades.[5] Besides the magnitude and duration of the theft, the scam was and continues to be covered in Indian media due to the extensive nexus between tenured bureaucrats, elected politicians and businesspeople that it revealed,[6] and as an example of the mafia raj that has penetrated several state-run economic sectors in the country.

As of May 2013, the trial has completed in 44 cases out of a total of 53 cases.[7] More than 500 accused have been convicted and awarded punishments by various courts.[8]

The scam[edit]

The scam had its origins in small-scale embezzlement by some government employees submitting false expense reports, which grew in magnitude and drew additional elements, such as politicians and businesses, over time, until a full-fledged mafia had formed.[6]Jagannath Mishra, who served his first stint as the chief minister of Bihar in the mid-1970s, was the earliest chief minister to be accused of knowing involvement in the scam.[9]

In February 1985, the then Comptroller and Auditor General of India, T.N. Chaturvedi, took notice of delayed monthly account submissions by the Bihar state treasury and departments and wrote to the then Bihar chief minister, Chandrashekhar Singh, warning him that this could be indicative of temporary embezzlement.[10] This initiated a continuous chain of closer scrutiny and warnings by Principal Accountant Generals (PAGs) and CAGs to the Bihar government across the tenures of multiple chief ministers (cutting across party affiliations), but the warnings were ignored in a manner that was suggestive of a pattern by extremely senior political and bureaucratic officials in the Bihar government.[11] In 1992, Bidhu Bhushan Dvivedi, a police inspector with the state's anti-corruption vigilance unit submitted a report outlining the fodder scam and likely involvement at the chief ministerial level to the director general of the same vigilance unit, G. Narayan.[12][13] In alleged reprisal, Dvivedi was transferred out of the vigilance unit to a different branch of the administration, and then suspended from his position. He was later to be a witness as corruption cases relating to the scam went to trial, and reinstated by order of the Jharkhand High Court.

Exposure and investigation[edit]

Laloo Prasad Yadav, then chief minister ofBihar, was a prime accused in the fodder scam investigation.

On 27 January 1996, the deputy commissioner of West Singhbhum district, Amit Khare, acted on information to conduct a raid on the offices of the animal husbandry department in the town of Chaibasa in the district under his authority. The documents his team seized, and went public with, conclusively indicated large-scale embezzlement by an organised mafia of officials and businesspeople.[11] Laloo ordered the constitution of a committee to probe the irregularities.[14] There were fears that state police, which is accountable to the state administration, and the probe committee would not investigate the case vigorously, and demands were raised to transfer the case to the Central Bureau of Investigation (CBI), which is under federal rather than state jurisdiction. Allegations were also made that several of the probe committee members were themselves complicit in the scam.[14] A public interest litigation was filed with the Supreme Court of India, which led to the court's involvement,[14] and based on the ultimate directions issued by the supreme court, on March 1996, theBihar High Court ordered that the case be handed over to the CBI.[15]

An inquiry by the CBI began and, within days, the CBI filed a submission to the High Court that Bihar officials and legislators were blocking access to documents that could reveal the existence of a politician-official-business mafia nexus at work.[16] Some legislators of the Bihar Legislative Council responded by claiming the court had been misinformed by the CBI and initiating a privilege motion to discuss possible action against senior figures in the regional headquarters of the CBI, which could proceed similar to acontempt of court proceeding and result in stalling the investigation or even prosecution of the named CBI officials.[16] However, U. N. Biswas, the regional CBI director, and the other officials tendered an unqualified apology to the Legislative Council, the privilege motion was dropped, and the CBI probe continued.[16] As the investigation proceeded, the CBI unearthed linkages to the serving chief minister of Bihar, Laloo Prasad Yadav and, on 10 May 1997, made a formal request to the federally-appointed Governor of Bihar to prosecute Laloo (who is often referred by his first name in Indian media).[17] On the same day, a businessman, Harish Khandelwal, who was one of the accused was found dead on train tracks with a note that stated that he was being coerced by the CBI to turn witness for the prosecution.[17] The CBI rejected the charge and its local director, U. N. Biswas, kept the appeal to the governor in place.[13][17]

Path to prosecution[edit]

A few days of uncertainty followed the CBI's request to the state governor to prosecute the chief minister. The governor, A. R. Kidwai, was accountable to the federal government, and had already stated that he would need to be satisfied that strong evidence against Laloo existed before he would permit a formal indictment to proceed.[18] The federal government, led by newly appointed prime ministerInder Kumar Gujral who had just succeeded the short-lived government of the previous prime minister HD Deve Gowda, consisted of acoalition that depended on support from federal legislators affiliated with Laloo for its survival.[13][19] It was also unclear why the CBI had sought the governor's consent in the first place and, when the High Court demanded to know why it was being sought, the CBI stated that it was a "precautionary measure."[20] The High Court, questioning the tactic, warned that it would allow some time for the permission to transpire, but if it sensed a delay, it would force a prosecution on its own authority.[20]

On 17 June, the governor gave permission for Laloo and others to be prosecuted.[21] Five senior Bihar government officials (Mahesh Prasad, science and technology secretary; K. Arumugam, labour secretary; Beck Julius, animal husbandry department secretary; Phoolchand Singh, former finance secretary; Ramraj Ram, former AHD director), the first 4 of whom were IAS officers, were taken into judicial custody on the same day.[22][23] The CBI also began preparing a chargesheet against Laloo to be filed in a special court. Expecting to be accused and imprisoned, Laloo filed an anticipatory bail petition, which the CBI opposed in a deposition to the court, listing the evidence against Laloo.[24] Also, on 21 June, fearing that evidence and documentation that might prove essential in further exposing the scam were being destroyed, the CBI conducted raids on Laloo's residence and those of some relatives suspected of complicity.[25]

On 23 June, the CBI filed chargesheets against Laloo and 55 other co-accused,[26] including Chandradeo Prasad Verma (a former union minister), Jagannath Mishra (former Bihar chief minister), two members of Laloo's cabinet (Bhola Ram Toofani and Vidya Sagar Nishad), three Bihar state assembly legislators (RK Rana of the Janata Dal, Jagdish Sharma of the Congress party, and Dhruv Bhagat of theBharatiya Janata Party) and some current and former IAS officers (including the 4 who were already in custody).[23] Mishra was granted anticipatory bail by the Bihar state High Court.[27] Laloo's anticipatory bail petition, however, was rejected by the same court, and he appealed to the Supreme Court, which resulted in a final denial of bail on 29 July.[26] On the same day, Bihar state police were ordered to arrest him.[28] The next day, he was jailed.[29] Later, the Bihar Director General of Police, SK Saxena, justified the one-day delay in arresting Laloo by stating in court that "any precipitate action would have led to police firing and killing of a large number of people."[30]

End of Laloo's chief ministership[edit]

As it became evident that Laloo would be engulfed in the scandal and its prosecution, demands for him to be removed from the chief ministership had gained momentum both from other parties,[31][32] as well as within Laloo's own party, the Janata Dal.[33] On 5 July, Laloo formally parted ways with the Janata Dal and formed his own party, the Rashtriya Janata Dal (or RJD), taking with him virtually all the Janata Dal legislators in the Bihar state assembly,[34] and winning a vote of confidence in the state assembly a few days later.[35]The RJD continued to support the coalition federal government, however.[34] With demands for his resignation continuing to mount, on 25 July, Laloo resigned from his position, but was able to install his wife, Rabri Devi as the new chief minister on the same day. On 28 July, 1997, Rabri's new government won another vote of confidence in the Bihar legislature by 194–110, thanks to the Congress andJharkhand Mukti Morcha parties voting in alignment with the RJD.[36]

Laloo claimed he had been instrumental in helping HD Deve Gowda become the prime minister.[37] However, there was press speculation that Gowda held a grudge against Laloo for insisting that Gowda step down when Gowda's fledgling government ran into internal coalition squabbles, and this motivated him to push CBI Director Joginder Singh for Laloo's prosecution.[22][38] Much later, in 2008, Laloo also claimed that Deve Gowda confessed, and "wept and fainted," when Laloo confronted him on inciting the CBI to pursue the prosecution.[37] Looking retrospectively, Laloo has said that the scam had a lasting negative impact on his political career, and may have ended his prospects to one day be prime minister of India.[39]

There were reports that Joginder Singh had violated norms in keeping the new prime minister, IK Gujral, in the dark as he pursued the prosecution.[38] Gujral's own new government also depended on Laloo for support in parliament,[40] and Joginder Singh later alleged that Gujral had attempted to block the scam investigation from proceeding.[41][42] On 30 June, the federal government issued orders to transfer Singh out of the CBI and into the Home Ministry as a Special Secretary,[40] which was technically a promotion but also had the effect of removing him from the investigation.[43] There was also an alleged follow-on move to transfer U. N. Biswas, the regional CBI director, which led to the High Court warning that it would act to disallow any such transfer.[44]

Prosecution[edit]

As the CBI discovered further evidence over the following years, it filed additional cases related to fraud and criminal conspiracy based on specific criminal acts of illegal withdrawals from the Bihar treasury. Most new cases filed after the division of Bihar state (into the new Bihar and Jharkhand states) in November 2000 were filed in the new Jharkhand High Court located in Ranchi, and several cases previously filed in the Bihar High Court in Patna were also transferred to Ranchi. Of the 63 cases that the agency had filed by May 2007, the majority were being litigated in the Ranchi High Court.[2][45]

Laloo's initial chargesheet, filed by the CBI on 27 April 1996, was against case RC 20-A/96, relating to fraudulent withdrawals of INR370 million (US$5.7 million) from the Chaibasa treasury of the (then) Bihar government,[23] and was based on statutes including Indian Penal Code sections 420 (cheating) and 120(B) (criminal conspiracy), as well as section 13(2) of the Prevention of Corruption Act, 1988.[46] Even though he had been jailed, he was kept in relative comfort at the Bihar Military Police guest house.[47] After 135 days in judicial custody, Laloo was released on bail on 12 December 1997.[48] The next year, on 28 October 1998, he was rearrested on a different conspiracy case relating to the fodder scam, at first being kept in the same guest house, but then being moved to Patna's Beur jail when the Supreme Court objected.[47][49] After being granted bail, he was rearrested yet again in a disproportionate assets case on 5 April 2000. His wife and then Chief Minister Rabri Devi was also asked to surrender on that date, but then immediately granted bail.[47] This stint in prison lasted 11 days for Laloo, followed by a one-day imprisonment in another fodder scam case on 28 November 2000.[47]

Jagannath Mishra had been permitted bail in June 1997, and avoided judicial remand when Laloo was first detained in July 1997. However, he was taken into custody on 16 September of the same year. He was freed on bail on 13 October but then remanded again, at the same time as Laloo, on 28 October 1998, when he was kept at the same guest house as Laloo, and later shifted to Beur jail along with him.[49][50] Mishra was freed on bail on 18 December,[49] but then rearrested in a different fodder scam case on 7 June 2000.[3]

Due to the multiplicity of cases, Laloo Yadav, Jagannath Mishra, and the other accused have been remanded several times in the years since 2000. In 2007, 58 former officials and suppliers were convicted, and given terms of 5 to 6 years each.[49] As of May 2007, about 200 people had been punished with jail terms of between 2 and 7 years.[45] A 2005 litigation of one of the cases (RC 68-A/96) in the Ranchi High Court involved over 20 truckloads of documents.[51]

On 1 March 2012, nearly 16 years after CBI was handled over the case, a special CBI court in Patna framed charges against Lalu Prasad Yadav and Jagannath Mishra along with 32 other accused. Of the total 44 accused, six have died, two have turned approvers, while two others are still evading arrest. The CBI had chargesheeted them in this case on 3 March 2003. The court said that the trial would begin soon.[52][53][54]

Disproportionate assets case[edit]

disproportionate assets (DA) case was filed against Lalu in August 1998. The Income Tax claimed that Lalu had amassed wealth of Rs.4.6 million out of the government treasury. Lalu and Rabri were chargesheeted in April 2000 and charges were framed by the court on 9 June 2000. Finally, the couple was acquitted on 18 December 2006 by a special CBI court.[55]

CBI didn't appeal against this verdict in high court. However, Government of Bihar challenged the verdict (of CBI court) in Patna High Court and the high court accepted the plea.[56] This verdict of Patna High Court was challenged by Lalu and the CBI in SC.[57] The SCin April 2010 declared that the Government of Bihar has no right to file appeal against acquittal of the accused even in cases where the CBI refuses to challenge the trial court or High Court's verdict favouring the accused.[58]

In yet another twist in the case, Government of Chhattisgarh in an unrelated case requested the Supreme Court to review its verdict in Lalu Yadav Disproportionate assets case. The Government of Chhattisgarh was aggrieved by Supreme Court verdict in DA case when it was trying to challenge the acquittal of former chief minister Ajit Jogi's son Amit Jogi in a murder case. After the trial court in Chhattisgarh acquitted Amit Jogi in May 2007, for over three-and-a-half years, the CBI again (similar to Lalu's DA case) did not file any appeal. Chhattisgarh High Court rejected Government of Chhattisgarh's appeal due to Supreme Court's order (which is binding on all) in Lalu Disproportionate assets case. On 19 March 2012, the Supreme Court agreed to review its own decision in Lalu's Disproportionate assets case.[59] However in May 2012, Supreme Court dismissed the Review Petition holding that the earlier Judgment did not suffer from any mistake apparent on the face of the record warranting any review.[60]

Convictions[edit]

As of May 2013, the trial has completed in 44 cases out of a total of 53 cases.[7] More than 500 accused have been convicted and awarded punishments by various courts. Some of the most prominent convicts include former CM of Bihar Lalu Prasad [61], formerMember of Parliament RK Rana and former Member of Legislative Assembly Dhruv Bhagat.[8]

On September 30, 2013 a Special CBI Court in Ranchi convicted Lalu Prasad Yadav and Jagannath Mishra along with 44 others in the case. 37 People were taken into judicial custody. The court is expected to decide their punishment on October 3. [62]


Impact[edit]

Since it broke into public light, the fodder scam has become symbolic of bureaucratic corruption and the criminalisation of politics in India generally, and in Bihar in particular. It has been called a symptom of the "deep and chronic malady afflicting the Bihar government and quite a few other state governments as well."[63] In the Indian parliament, it was cited as an important indicator of the deep inroads made by mafia raj in the politics and economics of the country.[64] Reference has also been made to the anarchic nature of governance (the "withering away of the state") that occurs when a mafia develops in a state-controlled sector of the economy.[65]

Laloo Prasad Yadav is the only person on whom the Lok Sabha debated for a complete session as the official agenda.[66]
